Britain: Information Commissioner updates guidelines on personal data
The British Information Commissioner’s Office has recently published a new guidance for freedom of information practicioners on the question of personal data when asking for access to documents under the Freedom of Information Act.
The news guidance emphasises, that personal data does not constitute a general exemption, but has to be considered carefully. “Information is not automatically exempt just because it is personal data. You will need to consider the details of the exemption. Any refusal notice will need to explain exactly which subsection applies, and why,” it says in the text and gives a clear and useful explanation on the Commissioners view on the exemption.
According to PublicTechnology.net the ICO is currently producing a range of new guidance documents on the practical application of the Freedom of Information Act.
